All sales by Matrix Uniforms made through this Website are subject to the following terms and conditions. You should read carefully the terms and conditions set out below. As by placing an order you will be deemed to have read, understood, accepted and agreed to being bound by the foregoing terms and conditions of sale.
The following terms and conditions apply to all transactions made on this Website. Please read them carefully. You may print a copy for your records.
1. Contract
These Terms and Conditions of Sale are incorporated in all contracts of sale between You and Matrix Uniforms, a company incorporated in Scotland (number SC213509) having its registered office at 45 McKenzie Street, Paisley, Renfrewshire, PA3 1LQ . Matrix Uniforms reserves the right to vary these Terms and Conditions of Sale at any time prior to accepting any order from You.
2. Price
All prices and delivery costs displayed on the website are quoted in pounds Sterling. Whilst Matrix Uniforms will exercise all reasonable endeavours to ensure that the prices and delivery costs quoted on the website are accurate, Matrix Uniforms reserves the right to change the prices at any time prior to accepting any order from You without prior notice.
3. Payment
Payment shall be made in Pounds Sterling by [MasterCard, Visa Card, Visa Delta or Switch] when You place your order. Payment will be debited from your account at the time of placing your order and before processing. It should be advised that by accepting your order we cannot confirm stock availability until your order has been sent for processing for dispatch. Matrix Uniforms will take all reasonable care to keep Your order and payment details secure, but purchases from this Matrix Uniforms website are at Your risk.
4. Passing of Title and Risk
Property and title in and to the goods ordered by you shall not pass to you until Matrix Uniforms has received payment in cleared funds for the price of the goods and all ancillary costs and the goods have been dispatched to you. The goods shall be at Your risk as from the time when the goods are delivered. Insurance on the goods once delivered shall be Your responsibility and at Your expense. Matrix Uniforms shall not be required to give You notice relating to insurance of goods referred to in section 32 (3) of the Sale of Goods Act 1979.
5. Availability
All goods which You may order on Matrix Uniforms website may be ordered subject to availability. Matrix Uniforms reserves the right at any time to make any changes to the specifications of the goods or to withdraw certain goods without notice. Whilst Matrix Uniforms will make every effort to have adequate stock of goods available, occasionally orders may not be capable of being satisfied out of stock. Should the item be out of stock for more than 7 working days from date of order Matrix Uniforms may offer you a similar product however should you subsequently decide to cancel the contract a full refund to Your credit card will be offered. Please allow ten days for the refund to be processed. Matrix Uniforms reserves the right to discontinue supplies of goods at any time and excludes all liability in respect of any claim arising from you or any third party caused directly or indirectly by such discontinuance.
6. Orders
An order is deemed to be an offer to purchase goods from Matrix Uniforms seen on the Matrix Uniforms website. The acceptance of such order by Matrix Uniforms shall be deemed effective when acknowledged and accepted by Matrix Uniforms by e-mail during the ordering process. Matrix Uniforms shall act upon any order so effected, but reserves the right to refuse any order. No order will be binding on Matrix Uniforms.
7. Delivery
Matrix Uniforms will make all reasonable efforts to ensure that the products you have purchased are dispatched to you within your requested time schedule and acceptance of Your order. Goods will be dispatched by [Royal Mail, DPD or Interlink] for deliveries in the UK. Delivery dates specified by Matrix Uniforms are estimates only. The express delivery service applies to orders placed before 2.00PM. Whilst we endeavour to deliver within 1-2 working days we cannot be held responsible for deliveries made out with the time scale. It is the responsibility of the customer to contact Matrix Uniforms to ensure the delivery option they have chosen can be offered against the chosen product. Should a customer request express delivery orders placed on Saturdays and Sundays are not counted as working days. Orders placed on a Friday will not be delivered until Monday at the earliest. Bank Holidays are not working days. Delivery to the Highlands and Islands will take longer. Whilst Matrix Uniforms shall use its reasonable endeavours to comply with such delivery dates, it shall not be liable for any failure to deliver by such dates or for any loss whatsoever arising from such failure. If You fail to take delivery of the goods or to give adequate forwarding instructions to enable the goods to be delivered, Matrix Uniforms /DPD will notify you by e-mail and should delivery not subsequently be possible will refund to You the price paid for the goods(but not the delivery costs) . Should goods be returned to Matrix Uniforms due to customer delivery failure an admin fee of £12.00 will be levied and a further delivery charge will be applicable for re delivery.
8. Claims and Returns
If You receive damaged or defective goods or have any missing garments in your order You should inform Matrix Uniforms within forty eight hours of receipt. Printed or Embroidered garments cannot be returned at any time unless faulty. A returns form should be downloaded from the website Matrix Uniforms and should be enclosed with a copy of Your paperwork together with the goods which must be returned at Your expense within fourteen days of delivery for inspection in order for the damage or defect to be assessed. If You do not notify Matrix Uniforms in such manner within forty eight hours and return the garments within fourteen days of delivery, You shall be deemed to have accepted the goods and shall not be entitled to reject the goods and Matrix Uniforms shall have no liability for such damage or defect. Where any valid claim relating to any defect in the quality or condition of the goods is notified to Matrix Uniforms in accordance with these terms and conditions, Matrix Uniforms shall be entitled to replace the goods free of charge or, at Matrix Uniforms sole discretion, refund You the price of the goods together with any reasonable costs incurred in returning the goods, but Matrix Uniforms shall have no further liability to You.
If You wish to cancel Your contract, You may do so by giving notice in writing (by post or e-mail) to Matrix Uniforms (at the address stated above) at any time after receiving confirmation of Your order until a period of seven (7) working days from the day after You received the goods has expired. You should also return the goods to Matrix Uniforms with a returns form and a copy of Your original paperwork. On such cancellation, Matrix Uniforms shall accept such goods only if they are returned to Matrix Uniforms, carriage paid by You, in the same condition as the original delivered goods and within fourteen days of Your receipt of goods. Unless there was an error on the part of Matrix Uniforms in dispatching an order, or the goods were faulty or the goods supplied were alternative goods supplied by Matrix Uniforms, the refund shall be exclusive of delivery and any other ancillary charges. You should allow 10 working days for refunds. If you are not satisfied with any goods received, or wish to return goods for any reason, please contact Matrix Uniforms within forty eight hours of receipt of the goods at [email protected]. Returns must be delivered back to Matrix Uniforms within fourteen days of customers receipt to allow a full refund.
8a.Restocking Charges
Restocking charges of £2.50 excl VAT per garment will incur on all Corporate wear and blouses. This charge is levied as items have to be re steamed and packaged on return.
8b. Sampling
We understand that garment sizes can vary between suppliers. For that reason samples can be ordered. Items must be paid for on order. They are fully refundable when returned within the 14 day return period in the original condition when ordered. Samples that have been washed, worn or processed in any way cannot be returned,refunded or credited.
9. Warranties
To the fullest extent permitted by applicable law, Matrix Uniforms disclaims all warranties, representations and undertakings whatsoever, express or implied, specifically including but not limited to warranties of satisfactory quality, or fitness for a particular purpose.
10. Liability
Matrix Uniforms shall not be liable for any direct or indirect, special, incidental or consequential loss or damage whatsoever arising out of or in connection with the supply of any goods or their use by You howsoever caused even if Matrix Uniforms has been advised of the possibility of such damages. Matrix Uniforms entire liability under or in connection with these terms and conditions shall not exceed the price of the products paid by You, except as expressly provided in these conditions.
You agree to use the goods in accordance with the instructions of the goods and any additional directions regarding use of the goods as may appear on this Matrix Uniforms website from time to time. [Such instructions and directions shall be incorporated into these Terms and Conditions of Purchase.] Nothing in these Terms and Conditions shall purport to exclude or restrict any liability the exclusion or restriction of which is prohibited by the Unfair Contract Terms Act 1977.
11. Privacy
Matrix Uniforms protects all of the information we collect from our customers. The information we collect such as your name, contact information and addresses are used specifically for the purposes of processing your orders. These details are not sold to any third party organisations, or used for marketing activities without your authorisation. We may periodically send your emails regarding specific promotions or products in your sector, however this will require your prior organisation. We have subject request forms available detailing all of the information we store on you, these are available at request. If you have any queries, please contact us with them directly. We will retain your information indefinitely unless you request it removed, as many of our customers have paid set-up fees, removing your information from our system would result in costs to return. You may have your data removed from our systems completely at your request, any applications can be made via email to [email protected]
12. Force Majeure
Matrix Uniforms shall not be liable for any delay or default in the execution of its obligations in the case of any event outside its control including but not limited to natural disasters, bad weather, fires, explosions, floods, failure or delay of third party suppliers, computer or software errors, national strikes, accidents, riots or civil uprisings.
13. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Scotland. You agree to submit to the exclusive jurisdiction of the Scottish Courts. You are responsible for compliance with any applicable laws of the country from which You are accessing this Matrix Uniforms Website.
BY PLACING AN ORDER YOU WILL BE DEEMED TO HAVE READ, UNDERSTOOD, ACCEPTED AND AGREED TO BEING BOUND BY THE FOREGOING TERMS AND CONDITIONS OF SALE.
